Hi experts...i need some advise from u all.

I have staff under probation, within 3 month, his performance is not good.company give another one month opportunity. One time catch stealing asset company and sell it , and keep the money. Due to certain issue, company give him another opportunity, still bad performance,. Since he is under probation, we don’t want to extend the probation period. The issue is, he had loan with company which is more than his monthly salary. So we decide to extend another 2 month under probation and discontinue his service. May i have some advise ...

Regardless probation or confirm staffs, the procedure remain the same. Showcause letter 1 If satisfy then okay. Else warning letter 1 Performance improvement plan (PIP) Under PIP, we need to have actions to help him for improvement such as training, coaching, counselling. If improve then case solve. If not solve. Showcause letter 2 If satisfy then okay. Else warning letter 2 Add inside Performance improvement plan. It must show continuous support and extra effort to be taken. IR (industrial relation) Court would review it if the case brings to the court. In the warning letter 2, it is a must to indicate that management is serious towards the performance and the low performance would lead to termination. If improve case close If not solve Showcause 3 Letter of termination. I hope it helps

Remember, Labour office with the new government really takes care of employees. Even employees lie, we have one case at sarawak lose even we have evidence of CBT and police report was made. IR Court mentioned even CBT and criminal case have to follow the procedure of showcause and warning. CBT and disciplinary also must do DI (Domestic investigation) after showcause letter.
