What should we do if the workers serving notice but at the same time working in another company, what should we do?

Kalau ada pekerja tengah serve notice berhenti, tapi pada waktu yang sama bekerja di syarikat lain tanpa kebenaran. Apa tindakan patut kami buat?

just because you put something on an offer letter - it does not mean it supercedes malaysian law. Ethics vs legality issues. If the person has tendered resignation and absconded while serving notice - then its grounds for immediate termination. You may withold any salary for services not rendered during the notice period. Should you terminate the person who is already working elsewhere. All parties win. Unless he is exhausting his annual till LWD. Then you might run into some problems
