If an employer dismisses a pregnant employee for gross misconduct must it still pay them maternity pay?
I work as HR and we have give her 30 days notice of resignation on 4 Dec 2020, because she have done a serious misconduct by abuse the company system with hide the error such as she not order the stocks from vendor but in system she change the facts at the system where she have order it and lying it to the company.
Before she were given the notice there also company alternatives to reprimanded her plus she also have admitted and have sign the writing statement that she write by herself on 2 Dec 2020 where she promise will not done the mistake again and not neglect her duties.
However, the promise seem not fulfill as she still neglect her duties on the next day where at that time she as a person in charge have neglect the stocks on the floor although the stocks have been arrived 2 weeks ago.
The managing director (MD)that also the owner, have came to the branch company by herself to solve the stocks matter. What more worse, the MD at time that also pregnant have to lift and the stocks by herself without being helping by her pregnant employee and also others two employees. The pregnant employee also busy by more playing her telephone without bothers to help.
Is there any case or sections/ act that can be used?
She also have made complain to Jabatan Tenaga Kerja and we want to counter claim her statements back as she the one that have an attitude problems.
