Resignation Notice Period After Deemed Confirmation – Need Advice

Hi.

I need some advice regarding a resignation notice during the probation period.

We have an employee who started work on 1 October 2024. Her contract states a 3-month probation, extendable up to 6 months depending on performance. It also mentions that:

  1. Management may issue a written confirmation at any time during the probation if satisfied with her performance.

  2. If no confirmation is given after 6 months, the employment is deemed automatically confirmed.

As of now, she has not received any written confirmation, but she submitted her resignation on 1 June 2025, giving 1 month’s notice.

According to the contract:

  1. During probation: 1-month notice

  2. After confirmation: 4-month notice

Since it’s already more than 6 months from her start date and no extension or confirmation was issued, would she be considered automatically confirmed and therefore required to give 4 months' notice?

As per mentioned agreement, supposedly she should give 4-months notice. However, did she receive any notice or benefits of confirmation employees? If yes, then maybe you can discuss with her because it depends on employee-employer arrangement.
