Can staff leave the company without acceptance of resignation letter?

If the employer asks staff to resign due to poor performance. Then the staff emailed resignation notice to superior serve 2 months' notice. Can use annual leave balance 19days to offset and leave early? If the employer said will issue to staff the Acceptance of Resignation letter only can leave. After 2 months the employer still not issue to staff the said letter. Can the staff just leave the company?

Yes, the staff have the right to clear their leave. Just to make sure that their leave balance is correct and pro-rated. The staff can leave, but there are no black and white to protect and proof the staff can leave. In future, the company might can say that the staff is MIA and also there is no benefit fot staff without black n white to protect themselves. It will benefit company instead.
