Hello, My employee gave resignation letter on 14.8.2020. She has prorated 14 days of Annual Leave. Her last day ( 3months notice) will be 14th November 2020. Do I need to pay her the 14 days of AL

Normal practise most organization is to prorate current year Annual Leave (AL) up to last official date. Example:

  • Current Year AL (2020): 18 days
  • Leave taken: 8 days
  • Resignation Served: 14 August 2020
  • Last Official Date (before offset AL): 13 November 2020
  • Prorated Leave: 18 days / 366 days x 318 days (from Jan-last official day) - 8 days (leave taken) = 8 days (official balance)


Some of organization will calculate divide by 12 months but if you want more details and accurate is good to calculate by days like above. Then official balance after calculate they can use either to offset or if you want them to work till last official day, you can pay balance of Annual Leave available (if they don't plan to take it during resignation period).
