If staff give 24 hours resign letter due to work stress, can he fight for justice in court?

Write to him that according to Letter of Offer, he still need to serve termination notice and failing which he shall pay in lieu of termination notice. If his salary not enough to contra the short notice, launch a report with JTK to claim the balance from him.
