According to Employment Act 1955, an employee is entitled to annual leave after the completion of 12 months continuous services. But most of the employers do not allow the probationer to take any leave during the probationer period.
Annual leave need to be prorated start from day one of the employment upon the completion of the probation, regardless the probationer is confirmed or terminated for his/her service.
Annual leave is pro-rated using this formula:-
(Number of completed months of service ÷ 12 months) × Number of days of annual leave entitlement
