Hello. Is it possible not to pay epf to part timer waitress?

Epf said that if u are under contract of service (employer-employee relationship) need to contribute to epf but if u are under contract for service (employer - independent contractor) no need to contribute. Can someone enlighten me on this ? The waitress is working in a kopitiam

Exp.. i am freelancer .. i provide service to ABC Sdn bhd.. i no any contract. i need issue inv to company. i will become under contract for service category.
