Company akan spin off and do migration without any compensation

Hi admin. Saya nak tanya dan minta pendapat. Saya baru join satu company ni Feb this year. And now, company akan spin off next year Feb dan saya salah seorang yang kena migrate. But from the letter, every term is remain without any increment and VSS compensation. Company pun ada tulis if we do not accept the offer, kita akan official serve the notice and to leave the company. So benda ni buat saya rasa a bit down bila baca new contract. Soalan saya, adakah saya entitle for any compensation since kita dipaksa to migrate and leave the current company?

Based on the information provided, it seems that the company is undergoing a spin-off and you have been selected for migration to the new entity. As an HR expert, I understand that such changes can be unsettling, especially when there is no mention of compensation or increment in the new contract. However, it is important to note that I am not a legal expert, and the specifics of your situation may vary depending on your employment contract and applicable laws.In general, when a company undergoes a spin-off or restructuring, there may be changes in employment terms and conditions. This can include changes in compensation, benefits, or even job responsibilities. It is not uncommon for these changes to occur without additional compensation or increments, especially if the new entity is starting fresh or facing financial constraints. In terms of entitlement to compensation, it would be advisable to review your employment contract, any relevant policies, and consult with a legal professional who can provide accurate advice based on the applicable labor laws in your jurisdiction. They will be able to determine if the company's actions are in compliance with the law and if you have any entitlement to compensation. As for the migration itself, if you decide not to accept the offer and choose to stay with the current company, it appears that the company has stated that you would be required to serve official notice and leave the company. Again, the specific details regarding notice periods and other legal requirements would be outlined in your contract and local labor laws.Ultimately, it is essential to seek legal advice in order to understand your rights and options in this situation. They will be able to guide you based on the specific circumstances and applicable laws. It can also be worthwhile to have a discussion with your employer or HR department to understand their reasoning behind the lack of compensation and to negotiate if possible.Remember that this answer is based on the information provided and may not cover all aspects of your situation. Therefore, it is crucial to consult with professionals who can provide tailored advice based on a comprehensive understanding of your circumstances.
