If staffs claims reinstatement at JPP, can they decline if company offered them reinstatement?

Wanna get advice regarding staff who claim reinstatement at JPP (IR Dept). Can they decline if offered reinstatement by the company?The company issued termination letter bcos the staff doesn’t perform during probation & now staff claim CD. Probation period is 3mths & staff was given termination letter about 1mth+1week after joining.

There are contradicting precedent cases regarding this. Sometimes it makes sense to decline the reinstatement offer if it is quite obvious is just an after-thought.

Termination within probation period, given only 1 mth chance to proof himself, that would be hard for the employee.
