My boss asked me: where in the Akta Kerja 1955 had mentioned that employer cannot ask staff to take annual leave ? or where does it mentioned that annual leave is to be taken voluntarily ?
Under situation of Force Majeure, can we ask staff to take leave(annual or unpaid) since Akta Kerja 1955 has no mentioned anything ? Can we list down pay-cut condition into Staff Manual and not against Akta at the same time?
When a company cannot force to utilize AL, how about:
Company close for festival (1 week), PH entitle 2 days. Balance 5 days where company decided to close for festival, employee's AL are being deducted.
If one staff keep on unpaid leave since MCO, donāt want to come to work, no reply show cause letter.
Can we just terminate her for the reason she not performing? She is under probation period.
