Can we request employee to take unpaid leave?

Hi all, would like to check on solution for below:-

Company started work on 19th May, but employee did not turn up. Managament called, but no answer, no reply text.
30th call up and request to join work. Company had applied for PSU and received PSU payment too.
Employee turn up and work again from 1st June. Can we request employee to take unpaid leave?
Any how, this employee is still under probation,

But management only ask this particular employee whom didn’t turn up on 19th to take unpaid leave, Whilst, employer did pay full amount for April salary..

Somehow employers are not allowed to ask employee to take paycut or unpaid leave or retrenched if employers are getting the PSU.


If you plan to ask your employee to take unpaid leave, please inform JTK at least 30 working days in advance before the action was taken. With this, you will no longer eligible to apply PSU. If SOCSO catches you doing so while receiving PSU, they will take stern action against your company.

Office starts operate on 19th, but employee fails to come to work till 30th? Then employee requested to come to work?


Why employee went MIA till 30th? This is subjected to termination due to insubordination.


Under this circumstance, can update SOCSO about this situation. I think they have no issue if company terminates employee due to disciplinary issue.

I suggest you bring this matter to Socso for further clarification. The rules is clear but there are certain cases, socso can help companies to overcome this circumstances.
