What's ORP? The curent practice is it 21 or 26 days?

This is no right or wrong, correct ? Whats ROP btw? For 5 working days a week November is 21 days. To use 26 also? Not 21? may I know the title of this book? What is the previous/current practice then? 26 days?  The law always say, deduct the minimal not more.

My company calculation for encashment & unpaid leave only using 26 days, for basic salary using the current month days (29, 30, 31 - depends on the current months itself)

In this case for those who are new joiner or resignee, might have a chance to report that u using 26 days calculation for not paying their rest day

Those not full month can use 26 too..must remember to include the rest day....

EA dint mentioned about that. I will say is common practice to use calendar month to calculate for unpaid leave, incomplete month for new hires and resignation. if you use 26 days to calculate salary for new hires and resignation(work in incomplete month), meaning that you are not paying their rest day.

JTK told me include the rest day for them no problem..end up is the company have to pay more with 26)

Calculation with 26 days is used only for the calculation of ORP (Ordinary Rate of Pay) like overtime, annual leave pay, sick leave pay, holiday pay and so on. (refer to EA section 60I)

Reduce trouble ..payroll directly use calendar day will be better..JTK and industrial court encouraged it..

Yes...previous & current always practice 26 days...same goes to deduct allowance as well..divided by 26.. Just confused when JTK officer said it was wrong
