The law says the minimum retirement age is 60 years. But that is minimum. Meaning, you cannot retire anyone before they reach 60. But the law does not say what is the maximum retirement age. You can choose to retire your employees at 61 or 62 or 65 or any age that you decide. Your first challenge is to determine your company’s retirement age first. And immediately issue a letter to every employees informing your companies retirement age. Once you have done that, you will then need to see if any employees are already above that age. If yes, issue them a letter to state when their employment will end. One advise to companies who intend to rehire a retire is to offer them reemployment on a yearly contract basis. And also carefully word your retirement clause in your employee handbook and offer letters.
